To get rid of a squatter in New York State by using a lawyer, you must:
1) Decide whether you will do the process yourself or hire an Attorney. In Rochester NY it is taking the big eviction Attorneys 1 to 3 weeks before they even call you back.
2) Either you or your Attorney will have to serve the squatter with a Notice to Vacate. The Notice to Vacate gives the squatter between 30 to 60 days depending on how long they have occupied your property.
3) Either you or your Attorney will have to file an eviction lawsuit if the squatter doesn't leave based on the Notice to Vacate. Which means that you or your Attorney will have to petition the Court for a court date. In Rochester NY it is typically taking about 30 to 45 days to get into Court.
4) Either you or your Attorney will have to Attend the court hearing and give the Judge your side of the story.
NOTE: In Rochester NY the squatter is allowed a 14 day adjournment, to find an Attorney of their own, if they ask the Judge at the initial court hearing.
5) At the second court date the Judge will hear all arguments and make a decision. Hopefully the Judge will decide in your favor you and grant you a Warrant of Eviction: If you are granted a Warrant of Eviction the Judge will decide when the Warrant of Eviction will be perfected. The minimum time is 3 days. However most times the Judge takes into account exigent circumstances concerning the squatter. Sometimes the Judge awards the squatter substantial time to move. We recently witnessed a case where the squatter was allowed to stay for an additional 45 days. It is not unusual for the Judge to give the squatter 2 weeks.
6) Once the Warrant of Eviction is finally perfected you will have to coordinate with the local Marshall or Sheriff to serve the squatter with the Final Eviction papers. In Rochester NY it is taking 2 and upwards of 10 days for the Marshall or Sheriff to serve those papers.
7) Once the Marshall or Sheriff serves the papers the the squatter has only 72 hours (3 days) to get out of the property.
8) You will have to contact the Marshall or Sheriff If the squatter doesn't leave in the 72 hours. At which time the Marshall or Sheriff will set a time to meet you at the property (1 to 4 days. Weekends excluded) to forcefully move out the squatter and witness you changing the locks.
Go through the numbers and add up the minimum days and you'll see that you are about 102 days MINIMUM from the moment you take you first step. If you add up the maximum numbers then you're at 170 days before you're property is free from squatter infestation.
